PROBLEM TO BE SOLVED: To provide a highly reliable optical element and its manufacturing method. SOLUTION: The optical element 100 comprises an optical section 144 having at least one of a light emitting portion 140 and a light receiving portion, a seal member 124 surrounding at least a part of the optical section 144 through an internal space 126, an electrode 109 connected electrically with the optical section 144, a conductive member 122 mixed into the seal member 124 and connected conductively with the electrode 109, a substrate 160 arranged oppositely to an optical plane 108 formed in the optical section 144, and wiring 162 formed on the substrate 160 and connected conductively with the conductive member 122 wherein the optical plane 108 is at least one of the exit plane and incident plane of light.
