PURPOSE: A digital video contents providing system for preventing an illegal copy/ circulation and a method thereof are provided to prevent illegal video contents from being played through a general video viewer, thereby preventing video contents from being illegally copied or circulated. CONSTITUTION: A contents storage unit(180) stores digital video contents. A contents encoding unit(140) encodes the video contents by inserting an encryption byte of the other standards into the video contents. A encoding information storage unit(160) stores encryption information about an insertion position and a length of the encryption byte. If a request of the digital video contents is received from a playback terminal device, a communication interface unit(120) transmits the encoded digital video contents and the encryption information to the playback terminal device.
