PROBLEM TO BE SOLVED: To provide a fixing device and an image forming apparatus configured to prevent toner from sticking to a contact part between a temperature sensor and a heat roller, and to prevent a fixation temperature required to fix a toner image from deviating from the temperature of the heat roller detected by the temperature sensor. SOLUTION: The thermistor 53 comes in contact with the outer peripheral surface N of the heat roller 48 in contact with the margin part T other than the printing area S of the conveyed paper P, consequently, the unfixed toner is prevented from sticking to the thermistor 53. The printing area S of the paper P does not come into contact with the outer peripheral surface N in contact with the thermistor 53, of the heat roller 48, consequently, the unfixed toner image is also prevented from sticking to the outer peripheral surface N of the heat roller 48. The thermistor 53 comes into contact with the outer peripheral surface N in contact with the paper-passing area X of the paper P, of the heat roller 48, consequently, the temperature of the outer peripheral surface N of the heat roller 48 detected by the thermistor 53 becomes nearly the same as that of the outer peripheral surface M of the heat roller 48.
