PROBLEM TO BE SOLVED: To provide an optical disk device capable of easily determining the type of an optical disk when focus search is carried out, and an optical disk determination method. SOLUTION: The optical disk device is provided with irradiation parts (15 to 17) for irradiating an optical disk with laser beams, a detection part (25) for receiving a reflected beam of the laser beam emitted from the irradiation part to be converged on an information recording layer and reflected on the optical disk and detecting a detection signal, and a determination part (31) for executing focus search at the irradiation part and the detection part and determining that the optical disk is a 3-layer optical disk based on the detection signal.
