PROBLEM TO BE SOLVED: To provide a recording device for recording information so as to enable seamless reproduction when the reproducing layer of the optical disk of a double-layer structure during reproduction, and an information recording medium on which the information is recorded by the recording device. SOLUTION: According to this information recording device, when a plurality of data groups having at least one of video information and voice information are recorded on the information recording medium having a first recording layer having a first recording capacity and a second recording layer having a second recording capacity, totals of data volumes detected by a data volume detecting means are sequentially calculated and, when the calculated totals of data volumes are determined to be equal to/lower than the first recording capacity, the data groups are sequentially recorded on the first recording layer. Thus, since each data group is recorded as a minimum unit, even when the reproducing layer of the optical disk of the double-layer structure is switched, seamless reproduction is carried out.
