PROBLEM TO BE SOLVED: To ensure an overwrite recording time having the same time as the erased time of a previously recored program by calculating an average coded bit rate from a recording time and a recorded capacity in a program as to an erasable or overwritable area and controlling the coded bit rate of a program to be newly recored while using this rate. SOLUTION: A TOC(Table of content) analyzing device 112 performing the information analysis of a TOC specifies the range of an overwrite area as a sector address on the TOC read out from an optical disk. A C/T calculator 114 calculates the average coded bit rate from the recorded capacity of the overwrite area and a time from a switch 113 to supply it to a bit rate specifier 109 as a control input (cont) via a switch 121. The bit rate specifier 109 calculates a coded bit rate (Renc) dynamically so as to coincide with this average coded bit rate by considering the degree of difficulty in the coding of a moving picture.
