PROBLEM TO BE SOLVED: To provide a modified polyester resin mainly composed of PET, suitable for obtaining a fiber structure such as nonwoven fabric having good flexibility and a flexible polyester fiber and a nonwoven fabric composed of the polyester resin. SOLUTION: This polyester resin comprises a polyester composed of an aromatic dicarboxylic acid component mainly containing terephthalic acid and an alkylene glycol component mainly containing ethylene glycol. In the resin, a phosphorus compound having a chemical structure represented by formula (1) (wherein R1 , R2 and R3 are each a 1-6C alkyl group) is copolymerized in an amount of 0.3-1.5 mol% based on total acid component of the polyester, and a temperature (Tmax ) at which tanδin dynamic viscoelastic measurement according to a method described in the present specification exhibits a peak is within the range of 70 to 110 deg.C.
