PROBLEM TO BE SOLVED: To provide a contents delivery system, its delivery method and its program capable of shortening delivery latency for contents. SOLUTION: The system composing a network configuration for delivering contents registered in a management server MS1 via a plurality of delivery servers DS2 and DS3 to a plurality of client terminals 21, 22, 31 and 32 being larger in the number as those of delivery servers, wherein the contents are delivered from other delivery server DS3 instead of the delivery server DS2 to shorten the delivery latency, when requests for contents deliveries are transmitted simultaneously to the delivery server DS2 from more client terminals than the possible limit of the delivery server DS2 to deliver simultaneously (the transmitting threshold value).
