The first UE is unconfigured for NOMA communication. The apparatus may also transmits data for a second UE on an enhancement layer. The second UE is configured for NOMA communication. Additionally, the base layer is overlayed with the enhancement layer. The reference signal may include a cell specific reference signal. The apparatus may be further configured to receive a traffic power ratio for the second UE to be followed by the second UE when the second UE is a base layer UE in a NOMA communication.
