PURPOSE: An interference cancelling apparatus and a method thereof using the control of a transmission mode in a wireless communication system are provided to reduce power consumption of a femto base station and reduce the interference by a femto cell by controlling the intensity of uplink signal. CONSTITUTION: A receiver(910) receives a signal from a terminal in case a transmission mode is an inactive state. A signal intensity measuring unit(940) measures the intensity of the received signal. A transmission mode controller(950) activates the transmission mode in consideration of the radio signal intensity. The transmission mode controller activates the transmission mode in case the reception signal intensity is higher than standard value.
