PROBLEM TO BE SOLVED: To prevent a reception acknowledging signal from remaining in a mobile terminal which returns a reception acknowledging signal in response to a reception of data. SOLUTION: A reception side mobile terminal 1 of the present invention includes a threshold change portion 24, a determining portion 22, a transmitter 18, and a transmission line control portion 23. The threshold change portion 24 changes a remaining determination threshold for determining whether or not transmission data remaining in a transmission buffer 20 according to a transmission state of a down link. The determining portion 22 determines whether or not the transmission data remains based on the amount of the transmission data including a reception acknowledging signal within the transmission buffer 20 and the remaining determination threshold. The transmitter 18 transmits a transmission data remaining signal to a base station, when the determining portion 22 determines that the transmission data is remaining. The transmission line control portion 23 increases a transmission speed of an up link with the base station, based on information transmitted from the base station according to the transmission data remaining signal transmitted by the transmitter 18.
