PROBLEM TO BE SOLVED: To provide a driving state determining device that determines the response state to the hazards of a driver, by estimating the length of time by which it takes a driver to start operating a brake pedal, based on the footpad position of the driver. SOLUTION: The driving state determining device 1 includes a footpad position detection sensor 7 that detects the footpad position of the driver; and an ECU 2, that estimates the time length needed by the driver to start operating the brake pedal and determines the operating state of the driver, based on estimated results. The device 1 estimates the length of time needed by the driver to start operating the brake pedal based on the footpad position, thereby determining whether the driver promptly responds to the hazard of looming obstacles, or the like; or in other words, determining the response state to the hazard of the driver.
