<P>PROBLEM TO BE SOLVED: To enable improvement of encoding efficiency. <P>SOLUTION: An MPM generation unit 301, among an upper adjacent PU and a left adjacent PU, determines a prediction mode of one with the same size as that of a target PU as a MostProbableMode. When both the upper adjacent PU and the left adjacent PU have the same size as that of the target PU, among the prediction modes of the upper adjacent PU and the left adjacent PU, one with a smaller prediction mode number is selected as the MostProbableMode. When neither the upper adjacent PU nor the left adjacent PU has the same size as that of the target PU, it is determined that there is none corresponding to the MostProbableMode, and a prediction mode of the target PU is obtained without using the MostProbableMode.
