A video encoding apparatus and method and a video decoding apparatus and method are provided to decode by using a basic layer bit stream and an extended layer bit stream, thereby harmonically operating with a video codec. An overlap conversion unit(412) determines an operation condition for performing overlap conversion. The overlap conversion unit provides a residue video which is overlap-converted to a converting unit(413). An overlap reverse converting unit performs an overlap reverse conversion according to a determined operation condition. A restoration video overlap-reverse converted in the overlap reverse converting unit is provided to a loop filter(419). A loop filter performs loop filtering according to the determined operation condition. A restoration video loop-filtered in the loop filter is provided to an adding unit(420). In the second basic layer coding module(410), overlap conversion processing and loop filtering processing are performed.
