<p><P>PROBLEM TO BE SOLVED: To provide a downlink communication transmission band allocation method that can keep fairness in usable bands among ONUs or reduce a buffer size for the same discard rate even in the state in which the usage rate of a link is a high state to some extent, in a multiple value/high order modulation PON system applying a layer coding format. <P>SOLUTION: The invention applies control which preferentially sorts a frame with a fewer candidates for a bit position than a frame with more candidates for a bit position, regarding the bit position where the frame with fewer candidates for the bit position can be sorted, to sorting algorithm in a layer coding processing unit.
