PURPOSE: An adaptable image encoding device and a method thereof are provided to perform encoding in an adaptable screen according to an encoding parameter of a peripheral block when spatial redundancy is bigger than time-based redundancy due to a local image property in the slice between screens. CONSTITUTION: A controller (310) performs the adaptable encoding based on a reference block identifier. A transmission unit transmits a bit stream including the information on the reference block identifier. An image encoding device (300) determines one reconstruction block previously reconstructed as a reference block based on the reference block identifier and determines the motion information applied to an encoding subject block based on the motion information of the reference block.
