PURPOSE: A light emitting device and a manufacturing method thereof are provided to prevent the deterioration of a light emission recombination rate by including a nonpolar active layer. CONSTITUTION: An active layer(112) is formed on one side of a first semiconductor layer(111) with a multiple well structure. The active layer is nonpolar. A second semiconductor layer(113) is formed on the active layer. A third semiconductor layer(114) is formed on the other side of the first semiconductor layer. The third semiconductor layer has one side of an irregularly uneven shape.
