PURPOSE: An apparatus and a method for controlling a transmission during a vehicle accident are provided to prevent a vehicle from sliding on a downhill by converting a gear control lever from N shift to P shift during the driving of the vehicle while a driver is unconscious. CONSTITUTION: An apparatus(100) for controlling a transmission during a vehicle accident comprises a collision sensor, a gear control lever controller, and a driver consciousness sensor. The collision sensor senses a collision at the occurrence of a collision while a vehicle is driving. The gear control lever controller converts a gear control lever from D shift to N shift when sensing the collision of the vehicle. After converting the gear control lever of the vehicle to N shift, the driver consciousness sensor senses the consciousness of the driver depending on a driver consciousness judgment factor, and transforms the state of the vehicle on the basis of the sensing results.
