PURPOSE: An overlapping function controlling method of home network and a universal plug and play device thereof are provided to prevent network usage increase due to the duplication of unnecessary function by preventing service from overlapping. CONSTITUTION: A device which provides specific service enters into home network(S110). Information of exclusive service provider provides specific service in the corresponding home network(S120). Information of candidate machine group which provides the same service as specific service is obtained in the corresponding home network(S130). The existence of exclusive service provider is judged(S140). A newly entered device waits for the predetermined delaying time(S150). A reception of events from other candidate device group is determined during the delay time(S160). A newly entered device is selected as a provider of specific service. An election event is generated(S170).
