A gas regulating valve 60 adapted to be interposed in a gas transmission duct of a breathing assistance device at a location proximal to the patient has a casing including a gas flow duct 61 and a housing 613, a gas leakage orifice 617 formed in the housing to allow flow of gas from within the duct to atmosphere via the housing, and an obstruction element 62 within the housing. The proximal 612 and distal 611 ends of the gas flow duct are coupled to the gas transmission duct going to the patient and to the gas source respectively so that the gas flow duct receives a flow of breathable gas between the source and the patient. A first side of the housing is in communication with the gas flow duct via the leakage orifice. The obstruction element 62 includes a movable element 622 which acts on a protection element 625 to vary the opening of the leakage orifice in response to a signal from a controller to the obstruction element. The protection element 625, provided as a flexible membrane, also isolates the obstruction element from the gas flow duct.
