<P>PROBLEM TO BE SOLVED: To provide a separator allowing a nonaqueous electrolyte battery to achieve excellent load characteristics and safety, and a nonaqueous electrolyte battery comprising the separator. <P>SOLUTION: A separator for a battery is made of a multilayer porous membrane comprising a resin porous layer mainly composed of a thermoplastic resin, and a heat-resistant porous layer mainly composed of heat-resistant particles. The heat-resistant porous layer contains a resin binder binding the heat-resistant particles together, and the percentage of the heat-resistant particles in the heat-resistant porous layer is 70 vol.% or higher with respect to the total volume of the components of the heat-resistant porous layer. The heat-resistant particles have an average particle size of 0.2 to 1 μm, the percentage of the particles of sizes larger than 2 μm is 10 vol.% or lower, and the heat-resistant particles are of polyhedral shapes each having an aspect ratio of 1 to 2.
