<P>PROBLEM TO BE SOLVED: To provide a device for preventing fire spread to upper floors, which more reliably blocks the outlet of a bend pipe in the case of fire; and a drain piping structure. <P>SOLUTION: A fire spread preventing device 2 comprises a cutoff pedestal 31 and a cutoff part 32 which are made of fire-resistant material. The cutoff pedestal which can be fixed downstream of a fire-resistant drain pipe 3 having an opening in horizontal direction comprises a cutoff pedestal body 33 having a hole in which the end of a non-fire-resistant drain pipe 5 to be connected downstream thereof can pass through, a pivot part 34 which is rotatably supports the cutoff part above the cutoff pedestal body, and a cylindrical side wall part 35 which is contiguous to the edge of the hole and projects from the cutoff pedestal body. The cutoff part comprises a cutoff plate 39 for closing an opening end 38 adjacent to the projecting end of the side wall part, and a rotatable axis 40 which rotatably supports the cutoff plate around the pivot part.
