PROBLEM TO BE SOLVED: To prevent setting of a reproducing control system or the like from mismatching with a system of an information recording layer or the like, even if the information recording layer different from the information recording layer to be accessed is accessed due to malfunction or the like of an information recording and reproducing device.

SOLUTION: An information recording and reproducing device comprises: a layer number acquisition section 222 for identifying an accessed information recording layer L1; and a layer-type discrimination section 223 for discriminating a kind of the information recording layer L1 identified by the layer number acquisition section 222.
