PURPOSE: A firmware update method of a mobile device and an apparatus thereof through a system flag are provided to prevent firmware update due to error of an unspecified update file. CONSTITUTION: A communication module(110) receives update files and checksum which a portable server supplies. A storage(130) stores the update files. A controller(180) distinguishes the compatibility of the update file before updating the firmware and controls firmware update. The storage confirms a system flag when booting a mobile device. The storage includes a boot loader, an update agent, and a user data storage area.
