<P>PROBLEM TO BE SOLVED: To improve the coding efficiency. <P>SOLUTION: A rectangular skip/direct coding unit 134 creates motion vector information in skip mode or direct mode by using a rectangular sub-macro block in an extension macro block as a motion partition. The rectangular skip/direct coding unit 134 requests a motion vector buffer 137 for the motion vector information of a necessary peripheral block, and acquires the motion vector information. A cost function calculation unit 131 creates a block_skip_direct_flag, adds 1 to that value, and calculates a cost function including the block_skip_direct_flag.
