PURPOSE: An uplink transmission device based on competition and method thereof is provided to reduce a delay time of an uplink data transmission. CONSTITUTION: A control unit(440) informs uplink transmission of a CB(contention Based) method to a terminal to be permitted. The control unit allocates a CB area for uplink transmission of the CB method. A modem(420) transmits the CB area information to at least one terminal including the terminal. The modem attempts to receive uplink burst by performing blind detection about at least one CB channel in the CB area.
