<P>PROBLEM TO BE SOLVED: To provide a thermal fixing device capable of bringing a pressure pad into close contact with a heating member sufficiently with simple constitution, and to provide an image forming apparatus having the thermal fixing device. <P>SOLUTION: A fixing unit 11 comprises: a heat roller 24 coming into contact with paper P; a pressure pad 25 disposed opposite to the heat roller 24; a support member 31 supporting the pressure pad 25 so that the pressure pad 25 can swing freely; and a tension spring 32 energizing the support member 31 so that the pressure pad 25 comes into pressure-contact with the heat roller 24. In the fixing unit 11, when the pressure pad 25 comes into pressure-contact with the heat roller 24, the pressure pad 25 is swung relative to the support member 31 so that the pressure pad 25 comes into close-contact along the heat roller 24.
