<P>PROBLEM TO BE SOLVED: To provide a light emitting element having improved emission efficiency, and to provide a light emitting element package. <P>SOLUTION: The light emitting element includes: a conductive support member; a light emitting structure which is formed on the conductive support member, and contains a first conductivity type semiconductor layer, a second conductivity type semiconductor layer and an active layer between the first conductivity type semiconductor layer and the second conductivity type semiconductor layer, and further contains an oxygen injection region wherein oxygen (O<SB>2</SB>) is injected into an upper region; and an electrode on the light emitting structure.
