A method and apparatus for spectrum access of the secondary user in cognitive radio are provided in the embodiments of the present invention. Firstly, according to the markov model adopted by the primary channels, the channel parameters of the primary channels are estimated; when the said primary channels are more than one, the primary channel which has the maximum available bandwidth is selected by utilizing estimated channel parameters; the selected primary channel is detected; after detecting that the channel is idle, the idle channel is accessed to transmit data. In this way, when the primary channels are more than one, the optimum primary channel is selected to access by means of estimating the channel parameters, thereby the higher data transmission requirements are met and system performance is improved.
