PROBLEM TO BE SOLVED: To achieve polarization nondependency regarding an optical element in which a directional coupler and an optical waveguide are connected. SOLUTION: The optical element 10 includes first optical waveguides 20a, 20b of a directional coupler 18 and second optical waveguides 22a, 22b that are connected to the first optical waveguides to guide light. A common clad for the first and the second optical waveguide is constituted of a first clad 14 and a second clad 16 which is installed on the first clad and provided with a refractive index larger than that of the first clad. The first and the second optical waveguides are mutually integrally and continuously formed on the first clad, with the width W and the height H made constant. The cross sectional shape of the first and the second optical waveguides is made a rectangular that is longitudinal in the direction orthogonal to the surface of the first clad.
