<P>PROBLEM TO BE SOLVED: To provide an optical element for suppressing bad influence by reflected light. Ž<P>SOLUTION: This optical element has a function of polarizing and separating incident light. The optical element includes a substrate 2 transparent for the incident light, a diffraction structure 3 that includes a plurality of projections 3a whole cross section has a sawtooth shape and is disposed on one surface side of the substrate 2, and a grid section 4 that includes a plurality of narrow lines 4a extending in one direction, and is disposed along the upper surface of the diffraction structure 3, on one surface side of the substrate 2. When λ is wavelength of the incident light, d is interval between the plurality of narrow lines 4a, δ is interval between the plurality of projections 3a, and n is refractive index of the constitution material of the substrate 2, these parameters establish the relation of d<λ and λ/n<δ≤λ.
