PROBLEM TO BE SOLVED: To reduce the processing load of encoding and to improve encoding rate, by adaptively determining whether to perform or not to perform deblocking filter processing according to the validity.

SOLUTION: A moving image encoder 100 determines whether to perform or not to perform the deblocking filter processing by a deblocking filter 140 in picture unit, based on a basic quantization parameter in next encoding determined based on a generated encoding amount and the basic quantization parameter of an encoded picture.
