PROBLEM TO BE SOLVED: To provide an electromagnetic induction heating type fixing device, not causing "a wax adhering image" on a record medium printed out even in the case of using toner containing paraffin wax having a melting point ranging from 60 to 90°C, and to provide an image forming apparatus. SOLUTION: This fixing device includes an induction heating part 25, which is opposite to the outer peripheral surface of a fixing member and heats the fixing member directly or indirectly by electromagnetic induction. The toner has paraffin wax having a melting point ranging from 60 to 90°C. An opposite surface 28a of the induction heating part 25 to the fixing member is provided with a passage 28a1 for causing the paraffin wax adhering to the opposite surface 28a to flow.
