A pickup device and a non-contact photographing method for initiating photograph based on the operation signal of a photographer are provided to prevent the flickering of a camera by initiating the photograph by recognizing the operation signal of the photographer. An operation recognizing system(200) recognizes clearly the operation of the intended user by using the photographing start signal. The recognition of movement system outputs the shutter signal. A pickup system(100) reacts to the shutter signal and initiates the photographing work of the subject. A pickup unit(220) outputs the image about the portion of a human body to the digital image signal. A body area extractor extracts the body region. An operation recognizer recognizes clearly the operation of the user.
