PROBLEM TO BE SOLVED: To provide a drinking determination device for highly precisely deciding a drinking state. SOLUTION: A drinking determination device is characterized by installing an alcohol determination means for detecting alcohol components included in breathing of a driver in a floor of a room in the vehicle. The specific gravity of the breathing of the driver is set so as to be heavier than that of air since carbon dioxide is contained. Thus, the breathing of the driver and alcohol components included in breathing are made to flow to a floor positioned at the lower part, and to drift on a floor. As a result, the alcohol determination means is installed on a floor inside the compartment so that it is possible to sufficiently detect the alcohol components drifting on the floor in the compartment, and that the reliability of the drinking state determination can be decreased.
