<P>PROBLEM TO BE SOLVED: To provide a fuel cell capable of always maintaining a thermal insulation at a suitable position against pinch-holding plates pinch-holding the thermal insulation, and improving thermal insulating properties. <P>SOLUTION: The fuel cell 1 includes a cell laminate 10 with a plurality of unit cells laminated. The cell laminate 10 is provided with a thermal insulation part equipped with a thermal insulation 21 and pinch-holding plates 22, 23 pinch-holding the thermal insulation 21 from both sides of a lamination direction, and pinch-holding the thermal insulation 21 with the pinch-holding plates 22, 23.
