PROBLEM TO BE SOLVED: To provide a sleeping state detecting method and a sleeping state detector to implement the sleeping state detecting method to correctly detect a sleeping state. SOLUTION: This sleeping state detector 2, which computes the opening of eyes from image data of a face which is obtained in time series and detects the sleeping state by distinguishing the sleeping state and a first awakening state with a different opening of eyes from the sleeping state, comprises a lower eyelid detection means to detect lower eyelids from the image data obtained in time series, a curvature calculation means to calculate curvature of the lower eyelids detected by the lower eyelid detection means, and a distinction means to distinct a second awakening state which is closer to the sleeping state than the first awakening state in eye opening, and the sleeping state based on the calculated curvature of the lower eyelids.
