Hydraulic EGR valve and EGR system using the same are provided to make the layout of the engine room excellent comparing with the layout that the hydraulic EGR valve is set up outside the engine room since the hydraulic EGR valve is mounted within the cylinder head. A hydraulic EGR valve comprises a valve cover(10) in which the oil suction path and the oil discharge path are formed in inside, a valve housing(20) in which the exhaust gas discharge room(27) is formed, a valve operator(31) mounted on the hollow of the valve housing. The valve housing contacts to the bottom surface of the valve cover. The valve housing includes a hollow(23) formed in inside, a flange part(21) formed in the upper edge, a ledge is formed in the predetermined depth from the upper side of the hollow, an exhaust gas inlet(36) formed at the bottom, an exhaust gas suction chamber(25), an exhaust gas outlet(28) formed at the boundary surface of one side.
