PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor for suppressing occurrence of excessive residual potential in a photoreceptor having a protective layer made of an inorganic material and achieving both of high durability and favorable electric characteristics, and to provide a process cartridge and an image forming apparatus using the photoreceptor. SOLUTION: The electrophotographic photoreceptor comprises a conductive substrate having thereon a photosensitive layer and a surface layer, layered in this order. In the elements constituting the surface layer, the sum of component ratio of group 13 elements, oxygen and hydrogen to the whole elements is 0.95 or more, and the composition ratio of oxygen to the group 13 elements (oxygen/group 13 elements) is 1.1 to 1.5.
