A video coding device and a method thereof are provided to update channel-adaptive intra using channel state information for increasing encoding efficiency and cutting off propagation of image degradation quickly. A video coding device comprises an encoding part(110), a channel state estimating part(140), an intra update control part(130), and a data rate control part(120). The channel state estimating part estimates state of the channel by receiving data rate and channel states from a receiving part. The encoding part has a video encoder(111), an encoder buffer(112), and a packet transfer part(113). The intra update control part, including an intra update time period determining part(132), and an intra update object macro block assigning part(131), determines an intra update time period corresponding to the channel state. The data rate control part controls/encodes the encoding part according to the intra update time period, wherein the intra update time period is shortened as a packet loss become large. A timer(150) checks time.
