PROBLEM TO BE SOLVED: To provide an optical element which has structure of difficult forgery and has constitution of easy authenticity discrimination. SOLUTION: The optical element 19 of this invention has a planar structure 11 where rugged structure patterns 11a, 11b capable of obtaining two or more kinds of different optical functions are formed on one surface and a dielectric layer 12 which is arranged at a surface side where the rugged structure patterns 11a, 11b of the structure 11 are formed, in which layer thickness is determined in advance, and which is made of one or more layers with an optical function.
