A mobile communication system for blocking spam transmission and a method thereof are provided to detect and block spams sent from spam senders who are not previously registered, in real time, thereby removing unnecessary traffic within a network, consequently stability in case of system operation can be obtained. An MSC(Mobile Switching Center)(130) receives a conversation request call or a short message sending request call through a wire/wireless communication network(170). An HLR(Home Location Register)(150) confirms whether a receiving number of the short message sending request call or the conversation request call exists, in connection with the MSC(130). If frequency which demands the call of a sending terminal(110) to the receiving number whose non-existence is decided on or frequency which demands transmission of a short message exceeds a particular threshold value, a spam detection server(160) decides a telephone number of the sending terminal(110) as a spam transmission number.
