An apparatus for processing a prepaid billing operation in a mobile communication network and a method thereof are provided to solve a problem that a service is billed after the service is provided in the conventional method by extracting and copying a partial packet of a service traffic, calculating billing information by using the extracted packet, comparing the billing information with the balance prepaid, and determining whether a service is stopped or not. An apparatus for processing a prepaid billing operation in a mobile communication network comprises a storage unit(231), a packet collector(232) and a service controller(233). The storage unit(231) stores information on a subscriber who prepays a fare wherein the information on the subscriber includes bill calculation criterion information and the balance prepaid matched with content data or content services. The packet collector(232) extracts a partial specific packet from packet data received from a user terminal or transmitted to a user terminal. The service controller(233) transmits availability of a prepaid bill service to a corresponding content providing server on the basis of estimated billing information generated from the bill calculation criterion information and the information on the subscriber by using the extracted or copied partial specific packet.
