PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor that is superior in mechanical durability and surface smoothness, capable of suppressing the occurrence of image defects attributed to adhesion of discharge products, having high sensitivity and capable of easily maintaining these properties at the high level with respect to passage of time, even when a surface layer of the organic photoreceptor is formed by a semiconductor production method that uses remote plasma, and to provide a method for manufacturing the electrophotographic photoreceptor, a process cartridge and an image forming apparatus that uses the electrophotographic photoreceptor. SOLUTION: The electrophotographic photoreceptor is obtained by stacking a photosensitive layer and a surface layer in this order on a conductive substrate, wherein the photosensitive layer consists of organic materials and the surface layer contains a group 13 element in periodic table and nitrogen, and has a thickness of 0.01 to 1μm or smaller and where the center line average roughness (Ra) of the surface is 0.1μm or smaller.
