<P>PROBLEM TO BE SOLVED: To provide a positive electrode active material for a nonaqueous electrolyte battery having superior filling properties and cycle properties, and the nonaqueous electrolyte battery using it. <P>SOLUTION: In the positive electrode active material used for the nonaqueous electrolyte battery, the positive electrode active material is lithium transition metal complex oxide, contains at least one kind of nickel or cobalt, has a layered structure.
