PROBLEM TO BE SOLVED: To form high-quality images for a long time by reducing the degradation of positive charging property due to repeated use. SOLUTION: The electrophotographic photoreceptor having at least a photosensitive layer and a surface layer on a conductive support is disclosed, which is characterized in that: the surface layer is formed of a crosslinked resin film by irradiating with UV rays a monomer mixture containing (α) radical polymerizable monomers having three or more functional groups and no charge transporting structure and (β) a radical polymerizable compound having a charge transporting structure; the irradiation energy of UV rays is controlled at 2 J/cm2to 7 J/cm2; and the highest temperature of the photoreceptor surface during irradiation with UV rays is 70°C to 90°C.
