A method for assigning priority for controlling a bit-rate of a bitstream, a method for controlling the bit-rate of the bitstream, a video decoding method, and an apparatus using the same are provided to adaptively adjust a bit rate for the purpose of obtaining an image quality of a picture having a higher layer in a bitstream. The first quality layers are formed in relation to a reference picture. The second quality layers are formed in relation to a present picture encoded based on the reference picture. A priority is assigned to the first quality layers and the second quality layers. A lower priority is assigned a layer little influenced by the deterioration of an image quality of the present picture even if the layer is removed. The reference picture and the present picture are a frame or a slice. The reference picture and the present picture have different resolution or different time levels.
