PROBLEM TO BE SOLVED: To provide a fixing device designed to increase the degree of freedom in design and used for selecting an optimum specification according to a status, and to provide an image forming apparatus that has the fixing device. SOLUTION: The fixing device includes: a heat roller 30 incorporating a halogen heater 33 as a heating member; a fixing roller 40 as a counter member, disposed opposite the heat roller 30; a fixing belt 50 extended by the heat roller 30 and fixing roller 40. A pressing member is composed of a pressure roller 60 disposed opposite the counter member. The foam cylinder 42 of a fixing roller 40 in the nip part N includes an elastic layer 43 in order to obtain a predetermined nip length in the direction of movement of paper P.
