PROBLEM TO BE SOLVED: To provide a moving picture photographing apparatus and method capable of consecutively photographing a moving picture even when there is no free capacity in a recording medium. SOLUTION: The moving picture photographing apparatus first identifies whether or not overwritten image data are included in image data written on a memory card when shifting to a reproduction mode. When the overwritten image data are included in the image data of the memory card, the moving picture photographing apparatus reads initial image data and thereafter reads the overwritten image data. In this case, the moving picture photographing apparatus reads the initial image data and the overwritten image data at a frame rate of 15 frames/sec from frames written with the overwritten image data and frames written with the initial image data in precedence over the initial image data 91 written with the frames, and reads the initial image data at a frame rate of 30 frames/sec with respect to the other initial image data than above.
