A method and an apparatus for terminating a voice call in a mobile terminal having a variable-rate vocoder are provided to reduce an unnecessary cost required to maintain a voice call by automatically closing an unnecessary voice call according to the voice activity of voice data in case an unintended voice call is connected between an originating mobile terminal and a terminating mobile terminal. An apparatus for terminating a voice call in a mobile terminal having a variable-rate vocoder(10) comprises a judgement part(20), a control part(22), and a user interface part(24). The judgement part(20) judges the data rate of a voice data frame outputted from the variable-rate vocoder(10). The control part(22), if it is judged that the data rate of voice data, encoded through the variable-rate vocoder(10), is the first data rate, compares the duration of the first data rate with the first critical time. In case the duration of the first data rate exceeds the first critical time, the control part(22) closes the voice call.
